Dudley v. CheckRedi of Kentucky LLC (FDCPA / EFTA, 2014)
In December 2014 a New York consumer, Melanie Dudley, filed a putative class action against CheckRedi of Kentucky LLC in the U.S. District Court for the Northern District of New York (Case No. 1:14-cv-01265) alleging violations of the Fair Debt Collection Practices Act and the Electronic Fund Transfer Act. The complaint alleged that CheckRedi made unauthorized withdrawals from the plaintiff's bank account totaling overdraft charges of approximately $140 to collect an underlying debt of $40.02, failed to identify itself as a debt collector during phone calls, and failed to provide written notice of the consumer's right to dispute the debt.
